Pursuant to this licence, the licensee acquires
a nontransferable and non-exclusive right
to use the software in accordance with the
provisions of this licence.
The licensee acknowledges that it
has exercised its independent judgment in acquiring
the software. The licensee acknowledges that the
very nature of gambling means that By-a-Nose can
not predict the winning horse in every race.
By-a-Nose guides the user by enabling him or her
to make an informed choice as to which horse to
place a bet on. The licensee releases Virtual Spectator
against all claims, suits, actions and demands arising
out of or in relation to the use or application
of the software and shall indemnify Virtual Spectator
fully against all liabilities, costs and expenses
which Virtual Spectator may incur to a third party
as a result of the use or application of the software.
This
license, your rights and obligations, shall be governed
by and construed according to the law of Victoria,
Australia. This agreement will not be governed by
the United Nations Convention of Contracts for the
International Sale of Goods.
